Terms of Service for Bono Percussion

These Terms of Service ("Terms") govern the relationship between Bono Percussion ("Company," "we," "us") and the customer ("Client," "you"). By accepting an estimate, issuing a Purchase Order (PO), or engaging in a virtual consultation, you agree to these Terms.

1. Estimates, Quotes, and Payments

  • Validity: Quotes and estimates are valid for 30 days from the date of issuance.

  • Authorization: By accepting an estimate via QuickBooks or issuing a Purchase Order (PO), you warrant that you are an authorized representative of your school, district, or organization with the legal authority to bind said entity to this expense.

  • Payment Terms: Invoices are issued upon completion of work. Payment is due according to the terms specified on the invoice (typically Net 30 for school districts).

2. On-Site Services & Safety

  • Work Environment: Client agrees to provide a quiet, safe, and accessible room for repairs. A representative of the Client must be available to provide access to the instruments.

  • Road Trip Logistics: On-site "road trips" are scheduled based on a minimum regional repair value (typically $3,000). While we do not currently penalize cancellations, we reserve the right to reschedule the entire trip if a cancellation causes the regional total to fall below the service threshold.

  • Travel Costs: Mileage, accommodations, and travel fees are built into the initial estimate and are non-negotiable once the work has commenced.

3. Liability & "Vintage/Brittle" Disclaimer

  • Assumption of Risk: Percussion instruments may be subject to age, environmental wear, or "brittleness." Client acknowledges that despite our professional care, the repair process involves physical stress on old materials that may result in unforeseen breakage.

  • Limitation of Liability: Bono Percussion is not liable for damage resulting from the inherent frailty of the instrument. Our total liability for any claim arising from our services is limited to the amount actually paid by the Client for that specific repair.

4. Virtual Consultations ("Tele-Repair")

  • Customer Responsibility: Virtual repairs rely entirely on the Client’s ability to follow verbal and visual instructions. Bono Percussion is not responsible for the outcome of a repair performed by the Client.

  • Tool Safety: Client is responsible for having the necessary tools and using them safely. We disclaim all liability for personal injury or further instrument damage sustained by the Client during a virtual session.

  • No Recording: Virtual sessions are for the Client's internal use only. Recording, redistributing, or re-selling our repair methods or video content is strictly prohibited.

5. Shipping & Parts

  • Shipping: For any parts or instruments shipped to us, the Client assumes all costs and risks of transit. We strongly recommend purchasing shipping insurance.

  • Warranties: We pass through all manufacturer warranties for new parts (e.g., Remo, Evans, Pearl). Bono Percussion provides no additional warranty on the parts themselves beyond the manufacturer’s terms.

6. Intellectual Property & Media

  • Media License: By uploading photos or videos to our site, you grant Bono Percussion a non-exclusive, worldwide, royalty-free license to use that media for assessment, marketing, and educational purposes.

  • Proprietary Methods: Our repair techniques and advice are the intellectual property of Bono Percussion.

7. Dispute Resolution & Governing Law

  • Governing Law: These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

  • Mandatory Arbitration: Any dispute arising from these Terms or our services shall be resolved through binding, informal mediation or arbitration in North Carolina, rather than in a court of law.
